Terms of Service

1. Who you are contracting with

Euphor (“Euphor”, “we”, “us”) is operated by Theo, of N2552 Co Rd C, Medford, WI 54451. These Terms govern your use of myeuphorai.com and the Euphor application (together, the “Service”). By creating an account you agree to them.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction if that is higher. The Service contains sexually explicit material and is intended solely for adults.

You may not use the Service if you are barred from doing so under the law that applies to you, or if your access has previously been terminated by us.

We may ask you to verify your age at any time and may suspend access until you do.

3. Your account

• One account per person. Accounts are personal and may not be shared, sold or transferred.
• Give us an email address you control and keep your password secret. You are responsible for what happens under your account.
• Tell us at [email protected] if you believe your account has been accessed by someone else.

4. Credits

The Service is paid for with credits. Credits are a prepaid, limited-use licence to access features of the Service. They are not money, not a stored-value instrument and not a security.

• Credits have no cash value and cannot be exchanged for money except as set out in our Refund Policy.
• Credits are not transferable between accounts and cannot be resold.
• Credits do not expire while your account is open. If your account is closed, any remaining credits are forfeited, except where a refund is due under the Refund Policy.
• The credit cost of an action is shown before you take it. We may change future pricing, but never the price of something you have already paid for.

Purchases are one-off. There is no subscription and nothing renews automatically.

5. Acceptable use

Our Content Policy forms part of these Terms. In particular, and without limitation, you must not use the Service to create, request or attempt to obtain any material that sexualises a minor, depicts non-consensual sexual activity, or depicts an identifiable real person in a sexual context without their consent.

You must also not attempt to circumvent the Service’s safety controls, including by instructing a character to change its stated age, by using coded language for a prohibited subject, or by automating access to the Service.

6. AI-generated content

Every character on the Service is fictional. Every message and image is produced by a machine-learning model in response to your input.

• Characters are not people. They have no feelings, memory outside your conversation, or existence beyond the Service.
• Output may be inaccurate, offensive or nonsensical. It is not advice of any kind — medical, legal, financial or otherwise — and must not be relied on as such.
• The Service is entertainment. It is not a substitute for human relationships, therapy or crisis support. If you are in distress, please contact a qualified service in your country.

7. Content and intellectual property

You keep whatever rights you have in the characters and prompts you write. You grant us a licence to store, process and display that content for the sole purpose of operating the Service for you.

We do not claim ownership of images generated for you, and we do not publish, sell or license your conversations or generated images to anyone.

The Service itself — the software, the site, the name and the marks — remains ours.

8. Suspension and termination

You may close your account at any time by writing to [email protected].

We may suspend or close an account immediately, without refund of consumed credits, where we reasonably believe it has been used to break the Content Policy or the law. Where an account is closed for a reason other than a policy breach, unused credits are refunded.

9. Disclaimers

The Service is provided “as is”. We do not warrant that it will be uninterrupted, error-free, or that generated output will meet your expectations. Image generation depends on third-party compute and may be temporarily unavailable.

10. Limitation of liability

To the fullest extent permitted by law, our total liability to you in connection with the Service is limited to the amount you paid us in the twelve months before the claim arose. We are not liable for indirect or consequential loss.

Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all rights the law gives you.

11. Changes

We may update these Terms. If a change is material we will give notice in the app or by email before it takes effect. Continuing to use the Service after that means you accept the change.

12. Governing law

These Terms are governed by the law of USA, and the courts of USA have non-exclusive jurisdiction. If you are a consumer resident elsewhere, you keep the protections of your local law.
